Can International Students Apply for NY Essential Plan

For international students studying at institutions in New York, including NYU, Fordham, Columbia University, SVA, and Parsons, a common question that arises is whether student visa holders are eligible for the New York Essential Plan, a health insurance program designed to provide affordable coverage for low- and moderate-income residents.

The good news is that international students may qualify for the Essential Plan if they meet certain eligibility requirements. While citizenship is typically a factor for many government-supported health programs, the New York Essential Plan includes provisions for certain lawfully present immigrants—and this category often encompasses international students on valid visas.

Understanding Eligibility Requirements

To apply for the Essential Plan, students must meet the following key criteria:

  1. Residency in New York State: Applicants must live in New York and be able to provide proof of residency.

  2. Income Guidelines: The Essential Plan is income-based. Applicants must demonstrate that their income falls within the specified range to qualify. It's important to note that parental support or living expenses provided by family members is NOT be counted as part of the student's income. Students who do not report a formal income may still be eligible based on their financial situation.

  3. Immigration Status: International students are considered "lawfully present" if they hold valid F-1 or J-1 visas, making them potentially eligible for this plan.

Quotes from Government Documents

Here are several resources you can use to clarify your eligibility:

The NYC government website offers a comprehensive FAQ poster about the Essential Plan. It answers questions about the benefits, costs, and immigration status requirements. Notably, it clarifies that individuals on valid non-immigrant visas (e.g., visiting students) can apply for the Essential Plan:

"If you are... in a valid, nonimmigrant status (for example, a visiting student with a valid visa).

USCIS Guidance on "Public Charge":

Many students were concerned that applying for Essential Plan will make them "Public Charge" and has impact on their transition of immigration status.

To address this concern, USCIS explicitly states that they do not consider Medicaid or health insurance under the Affordable Care Act (ACA) as part of public charge determinations. The Essential Plan, being a product of ACA, is unaffected by these rules.
